Confirmed Article 4 Direction Temporary Campsites 2024

Summary

AI generated summary
The New Forest National Park Authority issued an Article 4(1) direction, with immediate effect, to remove permitted development rights for using land as a temporary recreational campsite within the New Forest National Park. It applies to development that would otherwise be allowed under Class BC for temporary campsites, including sites first used before 1 March 2020 and used for up to 28 days per year. The Authority states this restriction is needed because allowing such campsites would harm proper planning and threaten local amenity. The direction covers all land within the National Park boundary shown on the attached plan. It was made on 17 October 2023 and was confirmed on 12 February 2024, remaining in force until 26 April 2024 unless confirmed, as set out in the order.

TOWN AND COUNTRY PLANNING
(GENERAL PERMITTED DEVELOPMENT) (ENGLAND)
ORDER 2015, AS AMENDED

DIRECTION MADE UNDER ARTICLE 4(1)
(WITH IMMEDIATE EFFECT)

WHEREAS the New Forest National Park Authority being the appropriate local planning authority within the meaning of Article 4(5) of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), is satisfied that it is expedient that development of the description set out in Schedule 1 below should not be carried out on the land described in Schedule 2 below unless planning permission is granted on an application made under Part III of the Town and Country Planning Act 1990 (as amended).

AND WHEREAS the New Forest National Park Authority considers that development of the said description would be prejudicial to the proper planning of its area and would constitute a threat to the amenities of its area.

NOW THEREFORE the New Forest National Park Authority in pursuance of the power conferred on it by Article 4(1) of the said Order HEREBY DIRECTS that the permission granted by Article 3 of the said Order shall not apply to development of the description set out in Schedule 1 on the land specified in Schedule 2.

THIS DIRECTION is made under Article 4(1) of the said Order and, in accordance with Article 4(4) and Schedule 3, shall remain in force until 26 April 2024 (being six months from the date of this direction coming into effect) and shall then expire unless it has been confirmed by the local planning authority in accordance with paragraph 2(6) of Schedule 3 of the said Order before the end of the six month period.

SCHEDULE 1

Development, being development comprised within Class BC of Part 4 of Schedule 2 to the said Order and not being development comprised within any other Class, consisting of any use of land as a temporary recreational campsite unless both of the following apply:
